1. Scope
These terms apply to all tattoo services provided by Havana GmbH (“we”) to customers (“you”). Deviating agreements must be made in writing (text form, e.g. email, is sufficient).
2. Consultation, design and booking
A request via our website, by phone or via WhatsApp is not yet binding. We discuss motif, size, placement and the expected effort with you and then propose a date. The appointment is binding once we have confirmed it and, where requested, the deposit has been received.
Designs are prepared for you individually. Minor technically required adjustments (line thickness, spacing, size) remain reserved so that the result stays durable.
3. Deposit, rescheduling and cancellation
To reserve the appointment and to cover the design work, we may ask for a deposit, the amount of which we will tell you when booking. The deposit is credited in full against the final price.
If you cancel or reschedule at least 48 hours before the appointment, we will credit the deposit to a new appointment. If you cancel later or do not attend, we may retain the deposit as compensation for the reserved time and the design already prepared. You remain free to prove that we incurred no loss or a significantly lower loss.
If we have to cancel an appointment, we will offer you a new date as soon as possible or refund the deposit in full.
4. Requirements on the day of the appointment
We only work on adults. Please bring a valid official photo ID (details in our age policy). Before we start, you confirm in writing that you have been informed and consent to the procedure.
Please come rested, having eaten and not under the influence of alcohol or drugs. Tell us beforehand about illnesses, allergies, skin conditions, pregnancy or medication — especially blood thinners. We may refuse or postpone the procedure for health reasons or if the requirements are not met; in this case section 3 applies accordingly, unless the reason lies with us.
5. Prices and payment
Price information before the appointment is an estimate based on motif, size, placement and expected time. The final price depends on the actual effort; we will inform you in good time if the estimate is likely to be clearly exceeded. All prices include statutory VAT where applicable. The price is due after each session. We will tell you the accepted payment methods when booking.
6. Procedure
Before the first needle, we transfer the design to your skin as a stencil; you check the size and placement and only then do we start. Skin types heal differently: colours and lines may look slightly different after healing, and identical reproduction of a template or photo cannot be guaranteed.
7. Aftercare and touch-ups
The result depends significantly on aftercare. Please follow our aftercare instructions and seek medical advice if there are signs of inflammation. Whether a touch-up makes sense is something we discuss individually after healing.
8. Copyright and photos
Designs created by us are protected by copyright. By paying, you acquire the right to wear the design as a tattoo; any further use (for example reproduction by another studio or commercial use) requires our consent. We only publish photos of your work with your separate consent (see our privacy policy); you can withdraw it at any time with effect for the future.
9. Gift vouchers
Vouchers are credited against the price of our services and can be redeemed in several parts. They are not paid out in cash. Unless stated otherwise on the voucher, it is valid for three years from the end of the year in which it was purchased.
10. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence, we are only liable for breach of essential contractual obligations, limited to the typical, foreseeable damage. Statutory claims remain unaffected.
11. Final provisions
The law of the Federal Republic of Germany applies; for consumers, only insofar as the protection granted by the mandatory provisions of the law of their habitual residence is not withdrawn. Should individual provisions be invalid, the remaining provisions remain unaffected. The German version is binding; the English version is for information.
